This is an absolute auction. All items will be sold to the highest bidder without reserve.
Acceptance of a high bid is a legal and binding contract enforceable in a court of law.
ALL ITEMS ARE SOLD AS IS! ALL SALES ARE FINAL! There are no warranties expressed, written or implied, as to the merchantability, fitness for use, age, description, or condition of any item in the auction. We do not represent or guarantee the hours on used equipment. It is the sole responsibility of the bidder to inspect each item and bid accordingly. IF YOU ARE UNSURE OF THE CONDITION OF AN ITEM, DO NOT BID ON IT!
PAYMENT- Online purchases must be paid in full by the end of the day on the Monday, April 6. Preferred payment is by wire transfer. Other acceptable forms of payment are cash, debit card, or credit card. Personal and company checks will not be accepted. If payment is not received by Wednesday, April 8, payment will be considered late and a $100.00 per day late fee will be applied.
There is a 10% buyer’s premium added to every purchase. There is a 3% surcharge added for credit card purchases. No surcharge for Debit Card.
7% Sales Tax is collected on everything unless a valid sales tax exemption certificate is on file UPON REGISTRATION. Sales Tax is collected on all titled vehicles unless a current auto dealer’s license is on file UPON REGISTRATION.
Items must be removed by the Wednesday following the auction. Removal times are two hours after the auction today, and from 9:00 to 4:00 Monday thru Wednesday. Items that cannot be removed by Wednesday will have to be removed by appointment only at the convenience of the County.
Titles will not be processed until the item is removed from the auction lot.
All items left on the auction lot after 10 days are subject to a $10.00 per day per item storage fee. All items left after 30 days are subject to sale at the next scheduled auction for storage fees. Garner and Associates Auctioneers will not be responsible for lost, stolen, or damaged items left after the auction.
Any legal disputes will be settled by binding arbitration in the jurisdiction of Polk County.
Tampering with or disabling items in the auction constitutes bid rigging and collusion and is a federal crime. It is a violation of the United States Sherman Anti-Trust act and will not be tolerated. Anyone found engaging in this activity will be subject to arrest and prosecution and bidding privileges will be permanently revoked.
Garner and Associates Auctioneers will collect all title fees and process all titles. Titles will only be put into the name of the person(s) who is the high bidder on that item. No exceptions!
Once your title is processed, only the registration will be sent to you by our company within 30 days. The title will be sent to you by mail from Tallahassee approximately 2 to 3 weeks after we process the paperwork at the tag office. We do not have temporary tags available.
IT IS VERY IMPORTANT THAT WE HAVE YOUR CORRECT ADDRESS FOR YOUR TITLE WORK OR YOU WILL NOT GET YOUR TITLE!

Title fees include the State of Florida title processing fees plus $75.00 Notary and Administrative fee.
DEALER TITLE FEE….. $20.00
OUT OF STATE TITLE FEE ….. $75.00
Trailers under 2000 lb … up to $75.00 and $20.00 Notary & Administrative fee. Tags must be purchased to transfer ownership.
